Travel Terms & Conditions

I, along with any dependents included in this travel package, hereby acknowledge that I have read, understood, and agree to the Terms & Conditions set forth by Arovis Travel & Tours Sdn Bhd (hereafter referred to as Arovis Travel), as outlined below. By proceeding with this booking—whether through online platforms, offline channels, or any other method of submission—I confirm my acceptance of these terms.

I understand that these Terms & Conditions govern my relationship with Arovis Travel and that this acknowledgment constitutes a legally binding agreement between myself, my dependents (if applicable), and Arovis Travel. This agreement covers all aspects of the travel package, including but not limited to payment terms, itinerary changes, and liability limitations.

By submitting personal information or completing the booking process, I accept full responsibility for ensuring that all details are accurate and up-to-date. I also acknowledge that failure to comply with these Terms & Conditions may result in consequences as specified herein, and I agree to abide by the laws governing this agreement.

1.0 Protection Under Malaysian Law

1.1 Licensed and Authorized Travel Agent:
Each customer of Arovis Travel is protected under Malaysian law, as Arovis Travel is a licensed and authorized travel agent, recognized by the Ministry of Tourism, Arts, and Culture Malaysia under the Tourism Industry Act 1992. The company holds a travel license for Inbound, Outbound, Ticketing, and Umrah services under License No. KPK L/N 10244. This license confirms Arovis Travel’s compliance with all applicable laws governing the travel industry in Malaysia.

1.2 Consumer Protection and Data Privacy:
Customers of Arovis Travel are also protected under the Consumer Protection Act 1999 (Act 599), ensuring that all services provided are in line with the agreed Terms & Conditions. This acknowledgment is to be read in conjunction with the Contracts Act 1950, which governs the enforceability of contractual obligations in Malaysia. Additionally, Arovis Travel is registered with the Personal Data Protection Commissioner (PDPC) of Malaysia under Section 15(1) of the Personal Data Protection Act 2010 (Act 709), under the category of 1401 – Tourism & Hospitality, ensuring that all customer data is collected, processed, and stored in full compliance with Malaysian data protection laws.

1.3 Legally Binding Agreement:
By proceeding with the booking and submitting personal information to Arovis Travel, you acknowledge and agree to be legally bound by the Terms & Conditions set forth in this document. This acknowledgment forms a legally binding contract between you and Arovis Travel, enforceable under Malaysian law. You further confirm that you have read and understood the Terms & Conditions and voluntarily agree to them as a condition of your booking.

2.0 Arovis Travel as a Third Party/Neutral Party

2.1 Intermediary Role:
Arovis Travel acts solely as an intermediary or agent between you, the customer, and third-party service providers, including but not limited to airlines, hotel accommodations, transportation services, and other ground service providers. Arovis Travel does not own, operate, or control any of these entities or their services and has no direct involvement in the provision of their services.

2.2 Limitation of Liability for Third-Party Services:
As an intermediary, Arovis Travel shall not be held liable for any loss, damage, delay, difficulty, injury, or other adverse circumstances arising from the performance or non-performance of services by third-party providers. This includes, but is not limited to, breach of contract, negligence (whether intentional or unintentional), misrepresentation, or failure of service by the airline, hotel, transportation company, or any other service providers involved in your travel package.

2.3 No Warranty for Third-Party Services:
Arovis Travel makes no express or implied warranties regarding the quality, suitability, availability, or safety of services provided by third-party providers. Any claims, complaints, or disputes regarding the services provided by third-party suppliers must be addressed directly to the respective service provider in accordance with their terms and conditions.

2.4 Changes in Service by Third Parties:
Arovis Travel shall not be liable for any alterations, cancellations, or modifications made by third-party providers after your booking has been confirmed. This includes changes to flight schedules, hotel availability, transportation routes, or the quality of services. Arovis Travel will make reasonable efforts to notify customers of any changes, but assumes no responsibility for the consequences of such changes.

2.5 Customer Responsibility for Compliance:
It is the customer’s responsibility to ensure compliance with all terms, conditions, and requirements imposed by third-party service providers, including but not limited to visa requirements, health protocols, and baggage restrictions. Arovis Travel is not responsible for any losses or inconveniences caused by the customer’s failure to comply with the terms of the third-party providers.

3.0 Accuracy of Personal Information

3.1 Responsibility for Accuracy:
After completing the booking and payment process, all personal information provided by you through the Traveller Registration Form or any other method of submission (including manual forms, online portals, or phone/email submissions) will be used by Arovis Travel to complete your travel package arrangements. It is your responsibility to ensure that all information provided is accurate, truthful, and up-to-date at the time of submission, regardless of the method used. Arovis Travel shall not be liable for any consequences arising from the provision of incorrect or outdated information.

3.2 Liability for Incorrect or Incomplete Information:
Arovis Travel shall not be held liable for any incidents, inconveniences, delays, or additional costs arising from incorrect, incomplete, or misleading personal details provided by you through the Traveller Registration Form or any other submission method. It is solely your responsibility to verify the accuracy and completeness of all personal information before submission. Any corrections or updates to personal details must be submitted to Arovis Travel promptly to avoid any disruption to the travel package arrangements.

3.3 Health Condition and Booking Rejection:
Arovis Travel reserves the right to reject your booking if your disclosed health condition poses a risk to your own health and safety or negatively impacts the comfort, safety, or enjoyment of other participants in the tour group. Should you require health-related assistance during the trip, you must arrange for a family member or qualified caregiver to accompany you and ensure that you bring any necessary medical equipment, such as wheelchairs, medications, or mobility aids.

3.4 Responsibility for Health-Related Care:
Arovis Travel is not responsible for providing personal care, medical attention, or healthcare services in the event you fall ill during the trip. If your medical condition necessitates personal care during the trip, Arovis Travel reserves the right to impose additional charges to engage third-party healthcare or caregiving services. You agree to cover any related costs and are responsible for ensuring that adequate medical insurance or assistance is in place before your departure.

3.5 Travel Insurance and Health Coverage:
It is strongly recommended that you obtain comprehensive travel and health insurance that covers potential medical expenses, emergency repatriation, or special medical assistance during the trip. Arovis Travel shall not be liable for any medical expenses or claims arising from your health condition unless such expenses are explicitly covered under the travel insurance provided with the package, if applicable.

4.0 Itinerary of the Package

4.1 No Guarantee of Suitability:
While Arovis Travel endeavors to provide high-quality services and experiences in line with the published itinerary, it does not guarantee that all events or activities are risk-free or suitable for all ages, physical abilities, or individuals with pre-existing health conditions. The customer is responsible for evaluating their own fitness, health, and ability to participate in the itinerary’s activities.

4.2 Assumption of Risk:
By participating in the package, the customer acknowledges that Arovis Travel shall not be held liable for any injury, health issues, pain, disability, or death resulting from participation in any part of the itinerary, including but not limited to events, excursions, or activities, whether or not mentioned in the confirmation letter, advertisements, brochures, or other promotional materials. The customer assumes all risks associated with participating in the travel package and accepts full responsibility for any consequences that may arise from such participation.

4.3 Health and Safety Responsibility:
The customer is advised to seek medical advice or clearance from a healthcare professional before engaging in any activity within the itinerary if they have concerns regarding their health or physical ability. Arovis Travel does not provide personal health or safety assessments and shall not be responsible for ensuring the customer’s fitness to participate in the offered activities.

5.0 Possible Itinerary Changes

5.1 Regulation Compliance:
Itinerary changes are subject to Regulation 9 of the Fourth Schedule of the Tourism Industry Act 1992. In the event of any changes to the itinerary, Arovis Travel will make reasonable efforts to provide an alternative itinerary. However, Arovis Travel does not guarantee that the alternative itinerary will match the cost, quality, duration, or value of the original one. The customer acknowledges that any changes to the itinerary may arise due to factors beyond Arovis Travel’s control, including but not limited to weather conditions, political unrest, flight cancellations, or unforeseen operational challenges.

5.2 Non-refundable Services:
Arovis Travel is not responsible for any non-refundable services or components of the trip (such as pre-booked excursions, accommodation, or transport services) that cannot be rescheduled due to itinerary changes. Any additional costs incurred as a result of changes to the itinerary, such as hotel surcharges, transport rebooking fees, or activity cancellations, will be borne solely by the customer.

5.3 Force Majeure Impact:
In cases of force majeure (including but not limited to natural disasters, strikes, health pandemics, or political disturbances), Arovis Travel reserves the right to make itinerary changes in the best interest of the customer’s safety and well-being. Arovis Travel shall not be liable for any claims, compensation, or refunds due to modifications caused by these events, as they are beyond the company’s reasonable control.

5.4 Customer Acceptance of Itinerary Changes:
By accepting these Terms & Conditions, the customer agrees that Arovis Travel reserves the right to make changes to the itinerary if necessary, and that such changes shall not constitute a breach of contract. The customer further agrees to accept any alternative arrangements provided by Arovis Travel as a satisfactory replacement for the original itinerary.

6.0 Payment Terms

6.1 Booking Confirmation:
Your travel package is considered fully booked only when the payment is successfully cleared in our bank account. If payment is made to any Arovis Travel staff, agents, or representatives, it must be deposited in the name of Arovis Travel & Tours Sdn Bhd. Arovis Travel does not accept responsibility for payments made to unauthorized individuals or in any name other than Arovis Travel & Tours Sdn Bhd. The customer assumes full responsibility for verifying that payments are made to the correct entity.

6.2 Payment Methods and Fees:
Arovis Travel accepts payments through various methods, including cash, bank drafts, personal checks, and authorized online payment gateways. Payments made via online gateways may incur additional processing fees, which shall be borne by the customer. Arovis Travel engages third-party service providers to handle online payments, including but not limited to Mpay Gateway (for Maybank Ezypay), CHIP In Sdn Bhd, and Securepay Sdn Bhd. The customer acknowledges that all transactions processed through these third-party providers are subject to their respective terms and conditions. Arovis Travel shall not be held liable for any issues, disputes, or delays arising from the use of these third-party payment services.

6.3 Late Payments:
For package payments made less than 7 working days before the departure date, Arovis Travel reserves the right to reject payment by personal check. If a confirmed cash payment or online payment is not received within this timeframe, your package booking may be automatically canceled without further notice. Any payments made prior to cancellation may be voided, and Arovis Travel shall not be liable for any losses or inconveniences caused by such cancellations. The terms of cancellation will be applied in accordance with Regulation 9 of the Fourth Schedule of the Tourism Industry Act 1992.

6.4 Government Agencies, GLCs, and Private Entities:
For Government agencies, Government-Linked Companies (GLCs), or Private Entities that book travel packages through a tender or quotation process, the payment terms will follow the agreed-upon conditions as set forth in the relevant tender or quotation documents. Any specific payment terms, deadlines, or conditions mentioned in these documents shall take precedence over the general terms in this Agreement and will govern the payment schedule.

6.5 Finality of Payment:
Once payment has been made and the package is confirmed, the booking becomes final and non-refundable, except as specified under the terms of 11.0 Cancellation and Package Changes. Customers are responsible for ensuring that all payment details are correct, as Arovis Travel shall not be responsible for any errors made in payment processing or in providing payment instructions.

7.0 Transport Policies

7.1 Ground Transportation Policies:

Arovis Travel reserves the right to determine the type and class of ground transportation based on the number of participants in the travel package. Ground transportation may include, but is not limited to, the following:

  • Bus
  • VIP Bus
  • Minivan
  • Van
  • Private Car
  • Other transportation as deemed suitable
 

Arovis Travel will ensure that the selected mode of transportation meets the necessary safety standards and is suitable for the group size. However, the traveler acknowledges that:

  • Changes in transportation type may occur based on availability, road conditions, or operational needs.
  • Arovis Travel is not liable for any dissatisfaction regarding the type of vehicle used, provided it meets the minimum requirements for safe and comfortable travel.
 

7.2 Ground Transportation Liability:

Arovis Travel is not liable for any delays, breakdowns, or incidents that occur during ground transportation that are beyond its control. This includes traffic conditions, road closures, or any unforeseen mechanical failures. The traveler acknowledges that:

  • Ground transportation providers are third-party contractors, and any disputes regarding the service must be addressed directly with the provider.
  • Arovis Travel will assist in facilitating communication between the traveler and the transportation provider but is not responsible for compensation or refunds related to transportation issues.
 

7.3 Force Majeure and Ground Transportation:

In the event of force majeure (e.g., icy roads, snowstorms, floods, or landslides), Arovis Travel may be required to change or upgrade the mode of ground transportation for safety reasons. The traveler acknowledges that:

  • Any additional costs incurred due to a change in transportation caused by a force majeure event (e.g., switching from a bus to a private car or VIP transport) will be the responsibility of the traveler.
  • Arovis Travel will inform the traveler of the additional charges as soon as possible and will arrange for the necessary transportation to continue the trip.
  • Travelers must agree to pay for such changes, or Arovis Travel reserves the right to cancel the ground transportation portion of the trip without a refund.
 

7.4 Traveler Conduct During Ground Transportation:

For the safety and comfort of all passengers, travelers are expected to adhere to the following conduct guidelines during ground transportation:

  • Comply with driver instructions.
  • Behave respectfully towards other travelers and the driver.
  • Refrain from any actions that may compromise safety (e.g., standing during the trip, distracting the driver).

In cases where a traveler’s behavior endangers others or significantly disrupts the travel experience, Arovis Travel will work with the transportation service provider to resolve the issue, which may include removal from the transportation service. Any additional costs incurred due to such removal (e.g., securing alternative transportation) will be borne by the traveler.


7.5 Flights:

7.5.1 Inclusion of Flights:

Flights are included in the travel package only if expressly specified. Any baggage allowances, in-flight services, and other flight-related policies are subject to the airline’s terms and conditions. Although flight confirmations and schedules may be issued to the traveler, these remain subject to change by the airline without notice. Arovis Travel shall not be liable for any damages, losses, or additional costs incurred due to changes in flight schedules, including but not limited to compensation for domestic ticket changes, baggage issues, missed connections, accommodation costs, or other consequential damages arising from such amendments.

7.5.2 No Liability for Airline Operations:

Arovis Travel shall not be held responsible for any claims, losses, or damages arising from schedule changes, flight delays, cancellations, missed connections, mechanical failures, inclement weather, seating reassignments, or baggage loss/delay. The customer acknowledges that all such matters fall within the scope of the airline’s operations and are beyond the control of Arovis Travel. The customer is advised to directly address any compensation or refund claims with the relevant airline in accordance with the airline’s policies.

7.5.3 Immigration and Boarding Issues:

Arovis Travel shall not be liable for any issues related to immigration or boarding, including but not limited to delays in customs or immigration processing, visa issues, refusal of entry, or boarding denials imposed by the airline or immigration authorities. The traveler is solely responsible for ensuring compliance with all visa and immigration requirements, and Arovis Travel cannot be held accountable for any disruptions or additional expenses resulting from the traveler’s failure to meet such requirements.

7.5.4 Force Majeure and Airline Responsibility:

In cases of force majeure or other extraordinary circumstances (including, but not limited to, strikes, political unrest, natural disasters, health pandemics, or airline insolvency), Arovis Travel shall not be held liable for flight disruptions. Any assistance provided by Arovis Travel in such events shall be offered as a courtesy, and any claims for compensation must be pursued with the airline or relevant authorities. Arovis Travel’s role is limited to facilitating communication and providing reasonable support but does not extend to financial compensation or legal responsibility.

7.5.5 Baggage Responsibility:

The traveler acknowledges that the airline is solely responsible for any baggage loss, theft, or damage that occurs during the flight. Any claims for lost, delayed, or damaged baggage must be addressed directly with the airline in accordance with their baggage policies. Arovis Travel is not responsible for processing, handling, or resolving baggage-related claims.

7.5.6 Airline Contract of Carriage:

By accepting the flight portion of the travel package, the traveler agrees to be bound by the airline’s contract of carriage, which governs the relationship between the traveler and the airline. Arovis Travel shall not be liable for any disputes or claims arising from this contract of carriage, as it is independent of the Terms & Conditions agreed upon between the traveler and Arovis Travel.

7.5.7 Seat Assignments:

Arovis Travel has no authority to assign or allocate seats for the traveler, as seating is entirely at the discretion of the airline. If customers wish to be seated together with family members or friends, it is strongly recommended that they request and purchase seat reservations through Arovis Travel or directly from the airline. Arovis Travel shall not be held liable for any inconvenience or inability to secure adjacent seats. However, if feasible, Arovis Travel will make reasonable efforts to liaise with the airline to accommodate such requests, though the final decision rests solely with the airline.

8.0 Accommodation, Hotel Changes, and Policies

8.1 Hotel Star Ratings: Hotel star ratings stated in advertisements, brochures, or communications from Arovis Travel are for reference only. Hotel ratings and standards may vary from country to country, and Arovis Travel does not guarantee that the rating reflects the actual quality of the accommodation.

8.2 Suitability of Hotel: Arovis Travel does not guarantee the suitability of the hotel based on its advertised rating, and you may not cancel your package due to discrepancies in hotel ratings or standards.

8.3 Accommodation Changes: Arovis Travel reserves the right to change the accommodation to an alternative hotel due to room unavailability, room damage, or other unforeseen circumstances. In such cases, you will be provided with at least 24 hours’ notice before check-in, and Arovis Travel will make every effort to find alternative accommodation that is of equivalent or higher quality.

8.4 Room Types and Facilities: Room types, amenities, and facilities vary by hotel and country. Arovis Travel does not guarantee that your accommodation will match the descriptions in advertisements or brochures. Arovis Travel shall not be liable for any inconvenience you may experience due to differences in room types, facilities, or the lack of certain amenities, such as Wi-Fi, gym access, or pool availability.

8.5 Check-in and Check-out Times: The check-in and check-out times for hotel accommodations are determined by the respective hotel’s policies. Arovis Travel shall not be liable for any inconvenience, delays, or additional charges that may arise from these policies, including any requests for early check-in or late check-out, which are subject to the hotel’s discretion and availability.

8.6 Room Allocation: Room assignments, including bed types, smoking preferences, and room location, are made by the hotel based on availability at the time of check-in. Arovis Travel cannot guarantee specific room preferences, and shall not be responsible for any dissatisfaction or claims resulting from the hotel’s room allocation decisions.

8.7 Hotel Facilities and Services: The availability and quality of hotel facilities and services (such as Wi-Fi, gym access, swimming pools, restaurants, and room service) are subject to the hotel’s policies and operational conditions. Arovis Travel shall not be liable for any changes, closures, or limitations to these services during your stay.

8.8 Hotel Rules and Regulations: Guests are required to adhere to the hotel’s internal rules and regulations, including, but not limited to, conduct within the premises, noise levels, use of amenities, and property damage. Any violation of these rules may result in penalties imposed by the hotel, for which Arovis Travel shall bear no responsibility.

8.9 Damages and Incidental Charges: Any damages caused to the hotel property or incidental charges incurred during the stay (e.g., minibar consumption, room service, or other hotel services) shall be the sole responsibility of the guest. Arovis Travel is not liable for any such costs, which must be settled directly with the hotel upon check-out.

8.10 Special Requests: Special requests (such as early check-in, late check-out, connecting rooms, or specific amenities) are subject to availability and at the sole discretion of the hotel. Arovis Travel shall not be liable if such requests are not accommodated by the hotel.

9.0 Category Definitions

For the purposes of categorizing travelers under Arovis Travel services, the following definitions shall apply:

  • 9.1 Adults: Defined as any individual who has attained the age of twelve (12) years, calculated as twelve (12) years and one (1) day on the date of travel. Any individual meeting this definition shall be deemed an adult for the entirety of the travel period, irrespective of the date of booking.

  • 9.2 Children: Defined as any individual who has attained the age of two (2) years but has not yet reached twelve (12) years. An individual shall be considered under this category if they are two (2) years and one (1) day to eleven (11) years and three hundred sixty-four (364) days on the date of travel.

  • 9.3 Infants: Defined as any individual who is under the age of two (2) years as of the date of travel. Upon reaching the age of two (2) years and one (1) day, the individual shall be reclassified as a Child under Clause 9.2.

The categorization herein shall be applied strictly as of the travel date and shall be a binding determinant for purposes of pricing, seating arrangements, and applicable travel policies. This categorization shall prevail unless otherwise altered by written agreement with Arovis Travel management, which may, at its sole discretion, approve reclassification based on exceptional circumstances, including but not limited to:

  • The physical size or build of the individual,
  • Specific health conditions or medical requirements,
  • Any other relevant factor deemed reasonable under the circumstances.

9.4 Supervision Requirement

For safety and compliance purposes, all travelers classified as either Children (Clause 9.2) or Infants (Clause 9.3) are required to be accompanied by at least one (1) Adult, as defined in Clause 9.1, who shall be part of the same travel package and assume responsibility for the minor(s) throughout the travel period. Arovis Travel shall not verify the legal relationship between the Adult and the accompanying minor(s) and shall regard the registered Adult as the designated legal guardian for the duration of the trip.

  • The accompanying Adult shall be responsible for ensuring the welfare and safety of the minor(s) and for complying with all travel-related regulations and policies applicable to minors.

  • Arovis Travel, its agents, and representatives shall not be liable for any claims, damages, or disputes arising from the relationship between the designated Adult and the accompanying minor(s).

This provision is intended to ensure the safety and supervision of minors during travel and shall be strictly enforced. Any exceptions to this clause must be expressly approved in writing by Arovis Travel management.

Arovis Travel reserves the right to require documentation or proof to substantiate the necessity of any requested reclassification or exception, and all such modifications shall not constitute a waiver of these terms and conditions in relation to other travelers.

9.5 Room Categories

Travel packages offered by Arovis Travel may be sold based on the type of room and bed arrangement, as outlined below:

  • Twin: Refers to a room arrangement where two (2) adults are accommodated with separate or shared beds. In the event that no suitable match is found for a customer who has booked a Twin room, Arovis Travel reserves the right to downgrade the package to a suitable arrangement that matches the available options. The difference in package price will be refunded to the customer after the trip is completed.

  • Triple: Refers to a room arrangement where three (3) adults are accommodated, typically with separate or shared beds. In the event that no suitable match is found for a customer who has booked a Triple room, Arovis Travel reserves the right to downgrade the package to a suitable arrangement. The difference in package price will be refunded to the customer after the trip is completed.

  • Quadruple or Quintuple: Defined as a category that includes rooms accommodating either four (4) or five (5) individuals, depending on the availability of the room type at the time of booking. This arrangement may vary based on the room allocation by the accommodation provider.

Arovis Travel reserves the right to adjust room assignments based on its assessment and understanding of the travelers’ relationship status, family structure, or any other relevant consideration. Such adjustments are made with the intent to ensure a comfortable and practical accommodation arrangement for all travelers.

This categorization will be specified and agreed upon at the time of booking, but may be subject to change based on room availability. Arovis Travel reserves the right to adjust room arrangements in the event of unforeseen circumstances or changes in the accommodation provider’s inventory.

10.0 Force Majeure

10.1 Exclusion of Liability: Arovis Travel shall not be liable for any failure or delay in performing its obligations, including cancellations, delays, changes, or disruptions in travel, due to circumstances beyond its reasonable control, including but not limited to acts of God, war, civil disturbances, labor disputes, government actions, terrorism, natural disasters, pandemics, public health emergencies, strikes, lockouts, mechanical failures, severe weather conditions, travel restrictions, or other unforeseen or extraordinary events (hereinafter referred to as “Force Majeure Events”).

10.2 No Obligation to Refund: In the event of a Force Majeure Event, Arovis Travel shall not be obligated to refund any portion of the fees paid for the package. Arovis Travel may, at its sole discretion, offer suitable alternatives such as rescheduling, issuing travel credits, or making modifications to the package. However, such actions shall not be construed as an obligation to do so, and no compensation or damages will be provided to the customer.

10.3 Customer Responsibility for Additional Costs: In the event that a Force Majeure Event necessitates additional costs, including but not limited to accommodation, transportation, or meal expenses, these costs shall be borne solely by the customer. Arovis Travel shall not be responsible for covering or reimbursing any such additional expenses incurred by the customer as a result of the Force Majeure Event.

10.4 Impact on Third-Party Services: Arovis Travel shall not be held liable for any actions, omissions, or failures by third-party service providers (such as airlines, hotels, ground transportation, or excursion providers) arising from Force Majeure Events. The customer acknowledges that third-party service providers may independently cancel, modify, or delay services due to Force Majeure Events, and Arovis Travel shall not be liable for any resulting losses, damages, or disruptions.

10.5 Modification of Itinerary: In the event of a Force Majeure Event, Arovis Travel reserves the right to make modifications to the travel itinerary, including changes to departure dates, transportation, accommodation, and scheduled activities, in order to minimize the impact of such events. Any modifications made under this clause shall not entitle the customer to cancel the package or request refunds, except as otherwise provided by Arovis Travel at its sole discretion.

10.6 Termination of Contract: If a Force Majeure Event results in the impossibility of continuing the package for an extended period of time, Arovis Travel reserves the right to terminate the contract with immediate effect. In such cases, the company will not be held liable for compensation beyond the refund of any recoverable portion of the fees not yet expended by Arovis Travel, subject to any deductions for expenses incurred.

10.7 Customer Acknowledgment: By accepting these Terms & Conditions, the customer acknowledges the possibility of Force Majeure Events and agrees that Arovis Travel shall not be liable for any disruptions, cancellations, or modifications to the travel package arising from such events. The customer further agrees to assume all risks and costs associated with Force Majeure Events and their impact on the travel arrangements.

11.0 Takaful & Travel Insurance Coverage

11.1 Group Takaful or Insurance Coverage: Arovis Travel provides limited travel group takaful or insurance coverage, as specified in the package materials. This coverage is limited to the terms and conditions outlined by the takaful or insurance provider selected by Arovis Travel. The customer acknowledges that this coverage may not be comprehensive and may not cover all possible risks associated with travel.

11.2 Additional Coverage Strongly Recommended: In accordance with Regulation 12 of the Fourth Schedule of the Tourism Industry Act 1992, Arovis Travel strongly advises all customers to obtain additional takaful or travel insurance to cover any potential risks during their trip, including but not limited to trip cancellations, medical expenses, emergency evacuation, lost or delayed luggage, personal liability, and accidents. You are free to select a takaful or insurance provider that best suits your needs.

11.3 Assumption of Liability in the Absence of Additional Coverage: If you choose not to obtain additional takaful or travel insurance, you fully acknowledge and agree to assume all risks and liabilities associated with the trip. This includes, but is not limited to, responsibility for penalties, damages, medical emergencies, repatriation costs, and any other unforeseen expenses that may arise during the course of your travel.

11.4 Exclusion of Liability: Arovis Travel shall not be liable for any claims, losses, damages, or expenses that may arise due to your failure to obtain adequate takaful or travel insurance coverage. In the event of a claim related to travel incidents, the customer agrees that all claims must be filed directly with the relevant takaful or insurance provider.

11.5 No Refunds for Unused Insurance: If a travel package includes group takaful or insurance as part of its offering, no refunds will be provided for any unused portion of the takaful or insurance coverage, regardless of whether the customer has purchased additional coverage.

11.6 Policy Review and Responsibility: If you have purchased additional takaful or travel insurance, it is your responsibility to carefully review the terms of your policy to ensure that it provides adequate coverage for your trip. Arovis Travel shall not be held responsible for any disputes between you and your takaful or insurance provider regarding the scope or applicability of coverage.

11.7 Pre-existing Conditions: Takaful or insurance coverage provided by Arovis Travel may not cover pre-existing medical conditions, and it is the customer’s responsibility to confirm whether their individual policy includes coverage for such conditions. Arovis Travel shall not be liable for any medical expenses or claims arising from pre-existing conditions unless expressly covered by the policy.

11.8 Emergency Assistance: Any emergency medical assistance, evacuation, or repatriation services will be subject to the terms and conditions of the takaful or insurance policy. Arovis Travel is not responsible for providing emergency medical services, and any costs associated with such services that are not covered by insurance must be borne by the customer.

11.9 Claim Procedures: In the event of an incident requiring a takaful or insurance claim, it is the customer’s responsibility to promptly notify the takaful or insurance provider and follow all required procedures. Arovis Travel will not act as a representative in claim disputes and shall not be responsible for any delays or denials of claims by the takaful or insurance provider.

12.0 Cancellation & Package Changes

12.1 Written Notification:
All cancellations or requests for changes to your package or travel dates must be submitted in writing or via email to the relevant Arovis Travel staff, clearly specifying the package in question. To avoid misunderstandings, you must also provide supporting documents, such as a death certificate, doctor’s letter, or any other relevant documentation (if applicable).

12.2 Cancellation Due to Personal Reasons:
If the cancellation of your package is due to personal reasons, you will be subject to the terms and conditions set forth in this agreement. If Arovis Travel receives notice of cancellation or requests for changes at least 45 days or more before the departure date, an administrative fee of RM50.00 or 2% of the total package cost (whichever is higher) per person will apply.

12.3 Cancellation Fees:
In accordance with Regulation 9 of the Fourth Schedule of the Tourism Industry Act 1992, if notice of cancellation is received less than 45 days before the departure date, the following cancellation fees will apply:

  • 22-44 working days before the trip: Forfeiture of deposit.
  • 15-21 working days before the trip: 35% of the package price.
  • 8-14 working days before the trip: 50% of the package price.
  • 3-7 working days before the trip: 75% of the package price.
  • 2 working days or less before the trip: 100% of the package price.
 

12.4 Associated Costs:
If flight tickets have been purchased or hotel bookings have been made at the time of cancellation, the customer must bear 100% of the associated costs in addition to the cancellation fees specified above.

12.5 Changes to Dates, Fares, or Taxes:
Any changes to travel dates, fares, or taxes are the sole responsibility of the participant. If Arovis Travel cancels the trip due to reasons such as safety concerns, emergencies confirmed by the relevant embassy, or airline schedule changes, we will provide two options after consultation with the airline: either to postpone the travel date or switch to another travel destination. If the customer does not accept either option, the booking fees will not be refunded, except for any amounts permitted under the relevant terms and conditions (if applicable).

12.6 Employer-Related Cancellations:
If your company, department, or employer cancels your leave or does not approve your leave after the booking has been made, Arovis Travel shall not be held responsible for any losses incurred. You must address this issue directly with your employer or department.

12.7 Immigration and Visa Issues:
If you face immigration restrictions or visa issues resulting in additional expenses, losses, or delays upon arrival at your destination, you will be fully responsible for all costs or losses arising from such restrictions. Arovis Travel shall not be held liable for any consequences or losses due to immigration or visa issues that may arise during your travel.

13.0 Rights of Arovis Travel

13.1 Use of Images and Names:
By participating in any package offered by Arovis Travel, you consent to the use, publication, or display of your images and names (if required) for advertising and publicity purposes. This may include publication, distribution, or display through any medium, whether physical or digital. You agree that Arovis Travel may use such materials without any royalty, compensation, or further approval from you.

13.2 Updates to Terms & Conditions:
Arovis Travel reserves the right to update these Terms & Conditions at any time. All updates will be posted on the website at https://booking.arovis.com.my/travel-terms-conditions/ In the event of any discrepancies between printed materials and the website, the terms published on the website shall prevail.

13.3 Limitation of Liability:
To the fullest extent permitted by law, Arovis Travel, including its officers, employees, representatives, and/or agents (including any third-party service providers engaged by Arovis Travel for the purpose of providing services related to this package), shall not be liable for any loss or damage. This includes, but is not limited to, the loss of income, profits, goodwill, or any indirect, incidental, consequential, exemplary, punitive, or special damages arising out of or in connection with the travel package, whether such liability arises in contract, tort, negligence, or otherwise.

13.4 Protection of Personal Data:
Arovis Travel will take reasonable precautions to secure your personal data in compliance with applicable data protection laws. Arovis Travel will also require third-party service providers who handle personal data on its behalf to take similar precautions. However, Arovis Travel may disclose your personal data if required by law, regulation, court order, or any legal processes.

14.0 Governing Law and Jurisdiction

14.1 Governing Law:
This Agreement, including any non-contractual obligations arising out of or in connection with it, shall be governed by and construed in accordance with the laws of Malaysia. Any disputes, claims, or controversies arising out of or relating to this Agreement, its performance, interpretation, or enforcement, shall be subject to the exclusive jurisdiction of the courts of Malaysia, without regard to its conflict of laws principles.

14.2 Foreign Legal Concerns During Travel:
In the event of any legal issues or concerns arising while you are traveling in a foreign country, the customer is encouraged to seek assistance from the Malaysian Embassy or Consulate in the respective country. Arovis Travel shall not be responsible for providing legal representation or advice regarding any incidents, violations, or disputes that arise under the jurisdiction of the foreign country’s laws. It is the responsibility of the traveler to comply with the local laws and regulations of the destination country.

14.3 Embassy Referral:
If necessary, Arovis Travel will assist in providing information on the location and contact details of the nearest Malaysian Embassy or Consulate in the country of travel. However, Arovis Travel shall not be liable for any actions taken by foreign governments, law enforcement, or authorities that may affect the traveler during their stay abroad.

14.4 Exclusive Jurisdiction in Malaysia:
Notwithstanding any legal issues that may arise abroad, any disputes between the customer and Arovis Travel relating to the performance or enforcement of this Agreement shall remain under the exclusive jurisdiction of the courts of Malaysia. The parties irrevocably consent to the personal jurisdiction of the courts of Malaysia and waive any objection to such venue, including claims of forum non conveniens. This clause shall survive the termination or expiration of this Agreement.

15.0 Declaration of Understanding

I, the undersigned, hereby confirm that I have read, understood, and agree to all the Terms & Conditions outlined above. By signing below (or by electronically agreeing via checkbox or other digital means, if applicable), I acknowledge that these terms are legally binding and constitute the entire agreement between myself and Arovis Travel & Tours Sdn Bhd (“Arovis Travel”).

I further confirm and agree to the following:

15.1 Acknowledgment of Responsibility:
I understand that I am fully responsible for adhering to the rules, regulations, and laws of both Malaysia and the countries I will be visiting as part of the travel package, as well as for providing accurate and truthful personal information during the booking process.

15.2 Waiver of Claims:
I waive any right to claim that I did not fully understand the terms of this Agreement or that I was not informed of any risks or obligations associated with my participation in the travel package. I accept that my failure to read or understand any part of the Terms & Conditions shall not relieve me of my obligations under this Agreement.

15.3 Binding Effect:
This Declaration of Understanding, along with the attached Terms & Conditions, shall be binding upon me, my heirs, executors, administrators, successors, and assigns. I understand that this Agreement constitutes the entire and exclusive understanding between myself and Arovis Travel regarding the subject matter herein, superseding any prior agreements or communications, whether written or oral.

15.4 Severability:
If any provision of this Agreement is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions of this Agreement shall continue in full force and effect.

15.5 Electronic Signature:
If I am agreeing to these terms electronically (via checkbox or digital signature), I acknowledge that this electronic agreement holds the same legal weight as a physical signature, in accordance with the Digital Signature Act 1997 and other applicable electronic transaction laws. My electronic acknowledgment shall constitute a legally binding signature.

15.6 Assumption of Risk:
I acknowledge that I have been informed of the risks associated with travel, including but not limited to health risks, safety risks, and risks related to transportation, accommodation, and other travel services. I voluntarily assume these risks and waive any claims or liability against Arovis Travel for any losses or damages that may arise from my participation in the travel package, except as may be caused by gross negligence or willful misconduct by Arovis Travel.
