This Liability Release and Waiver Agreement (“Agreement”) is made by and between Arovis Travel & Tours Sdn Bhd (“Arovis Travel”) and the undersigned participant (“Participant”), who has purchased or agreed to participate in a travel package or service from Arovis Travel. By agreeing to join any trip or package, either by checking the checkbox on the booking form for online submissions or by signing a manual submission for offline bookings, the Participant acknowledges that they have read, understood, and voluntarily agree to the following:

1.0 Assumption of Risk

1.1 The Participant acknowledges that participation in the travel package provided by Arovis Travel involves inherent risks, including but not limited to physical injury, illness, death, property damage, delays, and other unforeseen circumstances arising from factors such as transportation, accommodation, adventure activities, natural disasters, and political instability.

1.2 The Participant voluntarily assumes all risks and agrees that Arovis Travel, its officers, directors, employees, agents, contractors, and affiliated service providers shall not be liable for any injury, illness, death, or loss sustained during the travel package, except in cases of gross negligence or willful misconduct by Arovis Travel.

2.0 Waiver of Liability

2.1 The Participant, on behalf of themselves, their heirs, and personal representatives, voluntarily waives, releases, and discharges Arovis Travel and its affiliated parties from any claims or causes of action arising out of their participation in the travel package, including but not limited to claims for personal injury, property damage, or financial loss, except in cases of gross negligence or willful misconduct.

3.0 Indemnification

3.1 The Participant agrees to indemnify and hold harmless Arovis Travel, its officers, employees, and contractors from any claims, damages, or liabilities arising out of their conduct during the travel package.

4.0 Takaful & Travel Insurance Coverage

4.1 Arovis Travel offers limited travel takaful or insurance protection for certain packages as described in the package materials. The Participant is encouraged to obtain additional insurance or takaful for comprehensive coverage, including medical emergencies and trip cancellations.

4.2 The Participant is responsible for any medical costs incurred during the trip that are not covered under the provided insurance or takaful.

5.0 Force Majeure

5.1 Arovis Travel shall not be liable for any disruptions caused by Force Majeure Events such as natural disasters, acts of war, pandemics, government actions, or other emergencies beyond its control. Arovis Travel will make reasonable efforts to offer alternatives or reschedule, but is not obligated to provide refunds.

6.0 Responsibility for Personal Conduct

6.1 The Participant agrees to comply with all local laws during the travel package. Arovis Travel reserves the right to remove any Participant from the package without refund if they engage in behavior that is disruptive or dangerous.

7.0 Third-Party Services

7.1 The Participant acknowledges that Arovis Travel acts as an intermediary between the Participant and third-party service providers (e.g., airlines, hotels, ground transport companies) and shall not be liable for any injuries or losses caused by third-party negligence.

8.0 Payment and Refunds

8.1 The Participant agrees to the payment and refund policies outlined in the Travel Terms and Conditions. Cancellations and refunds will be handled according to those terms.

9.0 Enforcement of Agreement

9.1 This Agreement is enforced when the Participant agrees to join any trip or package offered by Arovis Travel, regardless of whether the booking is made online via checkbox agreement or offline through manual form submission. By participating in the trip or package, the Participant acknowledges that this Agreement is legally binding.

10.0 Governing Law and Jurisdiction

10.1 This Agreement is governed by the laws of Malaysia, and the Participant consents to the exclusive jurisdiction of the Malaysian courts for any disputes arising from this Agreement.
